This is the bottom line of every state opening early: they have to get people off the UI rolls that they’ve underfunded.

What I do not know about OSHA would fill volumes, and a suit for personal injuries under state tort would also seem possible, although OSHA could preempt tort law like worker’s compensation does.

A rough definition of gross negligence is reckless disregard of known consequences. Gross negligence usually leads to punitive damages.

Which is no doubt why Moscow Mitch says no relief bill will pass that doesn’t include protections from lawsuits for employers. If it’s safe enough to open up, why should they worry?

Isn’t being ordered by the President under the Defense Production Act to open a factory a defense against this very thing? They can argue that they closed the plant due to safety, but were forced to re-open, and poof goes any gross negligence claim.

Perhaps. I read there is a broad immunity clause in the Act, but I have not read the law myself.

Grain and vegetable processing/handling is no more immune to the virus than meat processing. It’s not the food itself, it’s who is handling it and whether or not the consumer is appropriately protected from them.

Even if Trump read the law or someone read it to him, he is not smart enough to understand it.

It’s actually more about the working conditions. There aren’t lettuce-packing plants where workers are jammed in shoulder-to-shoulder such that the virus spreads like wildfire.

He seems to break laws by accident on a regular basis; mostly due to his ignorance. Like playing a campaign video at a White House press briefing, or using AF1 as a backdrop to a campaign rally. This, of course, is all on top of the rampant corruption and criminality of his everyday life.

He is a two-bit thug.

It’s not cheap, but there are other sources of meat besides the giant processing plants.

Out of curiosity, have you ever worked in or around a commercial harvesting/processing operation?

This is true. But all the mom and pop meat markets in the country cannot possibly keep up with demand. They make up a fraction of the available processing capacity.

So slaughterhouse workers are told they’re essential, but not given any paid sick leave. They’re forced to work shoulder to shoulder. Meanwhile, crops are rotting in the fields because the USDA won’t buy them.
