This is weird. If Trump was told that he was not allowed to keep the files, and still kept the files, it would mean that all the times he claimed that he is allowed to keep them he was lying. Surely not.

It would also significantly bolster any prosecution for obstruction.

Also, Trump was President and could declassify whatever the hell he wanted to. Biden on the other hand wasn’t and did not have the authority to declassify documents.

I don’t think anyone here is saying Trump could not declassify documents, only that he did not.

Like everything else, there is a process, including blacking out sections of the document that must remain classified, and verifying that the document does not pertain to something the President does not have the authority to declassify like certain muclear intelligence.

By all accounts and evidence, Trump did not go through the required channels and processes therefore never actually declassified them.

We all know Biden did not have the authority to declassify, even though he had the same authority to view and possess them as the President.

However Biden never claimed to declassify them and has not obstructed justice by preventing them being returned or denied having them.

Therefore it was ridiculous to even bring up his name.

Trump, like any other President, has the power to declassify documents. To date, there is no evidence he actually did so. More importantly/notable, his attorneys have not advanced that argument in court. They’ve actually resisted signing an affadavit about any potential declassification.

Further, the Mar-A-Lago investigation is part of an inquiry into a possible violation of the Espionage Act. The Act makes no reference to classification status and prosecutors don’t need to prove a document was declassified as an element of a crime.

I’ll be honest, I didn’t read all of your ridiculously long post. Much like all of your posts. But Biden had no reason to have classified documents. He had no reason to lock them up with his Corvette. He had no reason to let Hunter go through them when he was living where the classified documents were. He stole the documents because they were incriminating to himself. Trump could declassify anything he wanted. He was President. This is nothing more than a “get Trump” scheme by democrats.

Trump was not allowed to remove any documents. The fact that some are classified ramps up the security concerns but is otherwise a red herring. They’re not his documents to have, he was told to give them back, he didn’t and then lied about it.

Biden and Pence discovered they had documents they shouldn’t have, advised NARA accordingly and allowed a full search of their residences to see if there was anything else they shouldn’t have. If Trump had just given the shit back when he was told to, it’s quite possible we would never have even known anything about any of this.

But regarding alleged declassification, assuming that all the docs were declassified appropriately, that would mean that they are now freely available for perusal by the public. How is that supposed to happen if they’re stuffed into the back of a drawer in Trump’s desk? This is why he was not allowed to take them, regardless of classification.

Look at it this way: your employer provides you with all the stationary you require to do your job. One day you get laid off and, on the way out the door, you stuff a bunch of pens and paper into your cardboard box. Now, your now former employer is probably going to be pissed when they realize that you took a bunch of supplies on the way out the door. It’s theft, but it’s just paper and pens so they probably won’t bother pursuing the matter further.

But what if it is then discovered that, mixed in with the stationary supplies, there was a bunch of proprietary sales materials? Do you think your former employer is going to want those back? Of course they are. Now imagine that mixed in with the sales materials was a printout of every employee’s name, address and SSN; they’re not simply going to ask at that point, they’re having the police kick in your door.

Right, exactly. The Presidential Records Act pretty clearly and explicitly states that these documents are the property of the government, not the former president - i.e. they’re not his to take with him.

There’s another point a lot of folks keep missing. While Trump and lawyers focus their arguments (such as they are) on his conduct, the warrant itself doesn’t specify a particular violator. Therefore, anyone who (mis)handled these documents potentially committed a crime.

He got off lightly on punitives last time. I think, this time, he’s facing an exponentially bigger award. It was literally the next day that he went out and defamed Carroll again live on national TV, regurgitating the same lies for which he had only just been found liable.

It’s a slam-dunk case that could involve an extensive and public review of his finances - a la Alex Jones - which would be the worst thing for him, given that I’m sure he has no intention of ever coughing up a cent. But Carroll can argue that Trump needs to be squeezed until he bleeds as anything less is clearly not a deterrent.

Jack Smith has subpoenaed financial records of Trump’s business dealings with foreign countries during and after his presidency. Sounds like he’s pulling on a radioactive thread here.

That he is doing this is surprising to me, due to my cynicism, but damn, it’s the most obvious thread to pull on. Any honest person who knows Trump’s history suspects that he had a reason for refusing to turn those documents over, and that reason is money or sex. Possibly blackmail, but blackmail needed for money or sex.
