The classification markings establish on the face of the documents that they are government records, not Plaintiff’s personal records. The government’s review of those records does not raise any plausible attorney-client privilege claims because such classified records do not contain communications between Plaintiff and his private attorneys. And for several reasons, no potential assertion of executive privilege could justify restricting the Executive Branch’s review and use of the classified records at issue here.
The DOJ laying this on pretty thick here.

Finding Out update:
Activists in Michigan got way more than enough signatures on a petition to have abortion rights added to the ballot in November. The Board of State Canvassers should’ve rubber-stamped this but, instead, the 2 Republican members on the 4-person board blocked it because things. So the activists went to the State Supreme Court who told the two to do their job or see some consequences.
This will be a big “get out the vote” issue for Democrats.
Judge Cannon gave Trump’s legal team a deadline of today to explain why they have dibs over the confidential documents retrieved from the search of Mar-a-Lago. Not surprisingly, Trump’s team asked for - and got - an extension of the deadline to Monday.
The DOJ’s previous filing artfully hoist Trump’s defense on its own petard. If the documents are classified, then clearly they are not Trump’s. So to keep the documents away from the DOJ, his lawyers are going to have to state in a court filing that he declassified them. The obvious follow-up from that being “prove it.”
There’s going to be a lot of soul-searching and ketchup throwing this weekend in Deadminster.
[As an aside, Lawrence O’Donnell has been making the very valid observation that Trump left these documents completely unattended in his desk and office closet for both last and this summer, while he was living in New Jersey. Jeez!]
It’s a odd question from this Judge given her previous ruling. I mean, if you’re not sure why they should have dibs on the documents, what’s the point of the special master?
The DOJ was surgical in making this about only the classified documents, so she has no ability to smokescreen this with the thousands of other docs. She’s asking the Trump team to give her a legit reason to hold to her decision, or she’s going to reverse herself.

However, for all we know, Deadminster has already been searched. The only reason we found out about Mar-a-Lago was because Trump sploodged that news on Truth Social.

Trump has reaffirmed that he wants the Special Master’s brief to include all materials, thus forcing Cannon to rule on the DOJ’s objection. She has very quickly reached the finding out part of fucking around with Trump.
Also, Trump want the United States - you and me - to split the cost of the Special Master that he wants to impose on the lawsuit he filed. Never misses a chance to grift.
