That’s a lower court ruling so, if and until SCOTUS rules on that or a similar case, I don’t think the lower courts ruling can be considered the final word.
Of course, while this SCOTUS would decide in favor of whatever is best for Trump, I am not so sure that their largesse extends to the likes of Bannon. Trump has a history of hanging his minions out to dry.
Actually, it is the final word if/until the SCOTUS rules to overturn it. That’s how the process works. But more to the point, I think the court record is rife with similar interpretations. Burdick was never meant to impute legal implications for accepting a pardon.

Word from the GOP is that this judge has now cemented her spot on the U.S. Supreme Court for the next Republican appointed/approved opening. This was her entire motivation for supporting Trump on this deal, the legal reasoning be damned. So yeah…it’s worse than a renegade judge, it’s actual, real-life cronyism for the ultimate position in American jurisprudence.
In addition to Bannon getting indicted for fraud tomorrow, Stewart Rhodes is in court today (well, his lawyers are, he’s in jail attending via Zoom) trying to get his trial postponed. It’s scheduled for Sept 27, and he’s trying to fire his current representation to appoint a new attorney.
The judge told him to get fucked. He refused to move the trial - apparently, at the defense’s insistence, they’ve pooled over 150 potential jurors - and refused to approve the change of representation. The judge told Rhodes he can have his new lawyers at the defense table too, if he wants, “it’s a big table.”
One of the reasons Rhodes gave for wanting new lawyers is that one of his original lawyers got arrested for her part in the Jan 6 riot. I’m no lawyer, but it’s probably not the best idea to be represented by someone who participated in the same crime as you.
Rhodes is still under the delusion that if he drags it out long enough, Trump will be re-instated as President, and he’ll be pardoned. And possibly named to a high-level cabinet post.
It’s almost as if the guy is a lifelong entitled grifter, who just sees anything not nailed down as his birthright, so a giant pot of money is irresistible to him.
