I thought it was going be a televised hearing, but Fani Willis’ response to the court - about the efficacy of trying all 19 RICOs (RICii?) together - dropped last night in the form of a filing to the court.
Willis pointed out the very real danger of some severed defendants filing for a speedy trial (Chesebro and Powell have already filed for both) will result in multiple trials that will - under the speedy trial law - be running simultaneously. This would require multiple court rooms, multiple judges, multiple juries, multiple prosecution teams and will burden the witnesses with having to testify multiple times.
Based on the above, Willis argued that trying a clown car of defendants all at once is something the County has handled before, while severing/batching them will result in circumstances that will overwhelm the court, the county and the witnesses. It’s a very good point.
Legal pundits did a lot of forehead-slapping over Willis’ filing, having not thought through the issue of a severed defendant then demanding a speedy trial. They suggested a fly in the ointment is that forcing some defendants into a speedy trial that they do not want (guess who?) could provide grounds for appeal. A solution would be to have the right to a speedy trial waived as a condition of any defendant being severed.
Basically, Willis has done this before, she is far more knowledgeable as to the quirks of Georgia law, and she is 10 steps ahead of everyone else.
She’s doing exactly what Biden has directed her to do.
She’s taken taken the “she can’t possibly try all 19 cases at once” talking head conventional “wisdom” and proved that it is, in fact, the most efficient, straightforward approach.
I see this repeated occasionally but have never seen any proof that Biden or any of his appointees or executive branch colleagues has ever done so. The only evidence I’ve seen of POTUS or any executive branch attempted undue influence of State & Local officials was during the last administration. What am I missing here?
