[His attorney] said she spoke by phone with one of the ICE agents during the arrest, who said they were acting on State Department orders to revoke Khalil’s student visa. Informed by the attorney that Khalil was in the United States as a permanent resident with a green card, the agent said they were revoking that too, according to the lawyer.
The arrest appeared to be among the first known actions under President Donald Trump’s pledge to deport international students who joined the protests against Israel’s war in Gaza that swept college campuses last spring. His administration has claimed participants forfeited their rights to remain in the country by supporting Hamas, a terror organization.
More litigation. A good lawyer will not let that blatant violation of the first amendment stand.
I’m sure Trump’s position will be that the student isn’t a citizen and doesn’t enjoy the protections of 1A. Which will just make it open season on all visitors.
Also, who knows what’s in someone’s mind who attends a demonstration. Maybe they don’t support Hamas, but were simply protesting Israeli actions, or looking for a date, or spying on those who support Hamas, or any old reason. The bar for supporting a terrorist organization should at a minimum be financial contributions or committing actions directed to them by the terrorist organization.
If I remember the law correctly, aliens also are protected.
There’s still a very sizable Portuguese community that area. I buy old vine Carignane from a vineyard near Alameda. The farmer’s last name is also Gonsalves and his family has owned the vineyard for five generations. I’d be willing to bet he’s somehow related to the MOH recipient.
And I think that’s the precedent that’s been followed for decades, if not longer. But with these thugs in office, all bets are off.
Not everyone will have access to a good lawyer. Not everyone will have access to any lawyer before they are shipped off to Gitmo or to wherever is currently accepting humans trafficked by ICE out of the country.
That is what they are banking on. That, and the fear this will instill which will make some people leave and some people not come here. This is the ultimate goal and - ignoring what will be tremendous human suffering - it will be a disaster for the economy.
There are very good lawyers in Legal Aid, and others will be lining up to take the case pro bono.
That wasn’t the point I was making. They are shipping people out on military flights, and I have no confidence that there aren’t people already who have been scooped up off the street and put on one of those flights before anyone even knows they’re in custody.
Even if you’re a natural-born citizen, try fighting your way back from Honduras or wherever with no money or ID.
